NDC’s Objection Rejected: Court Allows NPP to Pursue Election Re-Examination

An Accra High Court has overruled the National Democratic Congress (NDC)’s legal objection, clearing the way for the New Patriotic Party (NPP) to proceed with its mandamus application against the Electoral Commission (EC).

The NPP had filed a mandamus application, seeking to compel the EC to re-collate parliamentary election results in four contested constituencies: Okaikwei Central, Ablekuma North, Tema Central, and Techiman South.

The party argues that there were irregularities during the initial collation process and is seeking a re-examination of the results.

In response, the NDC raised a preliminary objection, claiming that the NPP’s application was effectively an election petition masquerading as a mandamus request.

The NDC argued that once election results have been declared, the court cannot issue a mandamus order to change or revisit the results.

However, in a ruling that surprised many, the presiding judge disagreed with the NDC’s contention.

The judge maintained that the court’s jurisdiction had been rightly invoked to ensure the EC acts in line with the law, regardless of the results already declared.

This verdict allows the NPP’s application to move forward and be heard in its entirety.

As the court proceeds with the case, the NPP’s legal team is focused on pressing for the EC to revisit the disputed constituencies and rectify any discrepancies that might have affected the election results.

On the other hand, the NDC insists that no re-collation is needed, as the results have been finalized and declared by the EC.

The case continues to generate significant attention as both parties gear up for what promises to be an intense legal battle over the election results.
